What are fiduciary duties?

Fiduciary duties are duties that trustees and executors owe to beneficiaries of an estate or trust. Essentially, a fiduciary must act in the best interest of the beneficiaries. The most common fiduciary duties involved in trust and estate disputes include the duty of loyalty, the duty of impartiality and the duty to appropriately account to the beneficiaries.
