What is undue influence?

Undue influence is a grounds that can be used to contest a will, a trust, or even a beneficiary designation form. It can occur when someone improperly exercises control and influence over the mind of another so that they prepare estate planning documents or beneficiary designation forms that name them as the beneficiary, rather than the beneficiaries that the testator actually intended to receive the assets.
